Statement on New Lawsuit Against FanDuel and DraftKings

SAN FRANCISCO, March 26, 2026—Common Sense Media Founder and CEO James P. Steyer issued the following statement on a new lawsuit alleging that FanDuel and DraftKings use design features that intentionally addict users:

"Yesterday, a Los Angeles jury told Meta and YouTube that designing addictive products that harm children has consequences. Today, the same attorneys filed suit against DraftKings and FanDuel for doing the exact same thing.

"That is because the model is identical. Identify the most susceptible users, keep them engaged, maximize their losses. Algorithms that track when you're most vulnerable. Push notifications precisely timed for your weakest moments. Dedicated account managers whose job was to make sure people never stop.

"Common Sense Media's research shows that a third of adolescent boys are gambling before they can vote. The industry knew that.

"AB 2617 exists because we cannot wait for litigation to sort this out over the next decade while the next generation gets hooked on gambling. California has a chance to set the standard now. We look forward to working with Assemblywomen Schiavo and Bonta to make that happen."
