The California legislature currently is considering a bill that would expand the definition of "tobacco product" in certain sections of current law to include electronic cigarettes. The bill would make the sale of electronic cigarettes subject to enforcement under the Stop Tobacco Access to Kids Enforcement (STAKE) Act (SB 140). It also would prohibit the use of electronic cigarettes in public spaces, including schools.
Common Sense Kids Action supports the legislation's goal to redefine "smoking" as it's described in the STAKE Act to include the inhaling, exhaling, burning, or vaping of any lighted or heated cigar, cigarette, or pipe intended for inhalation, whether natural or synthetic. This definition would include the use of electronic smoking devices that create aerosol or vapor or the use of any oral smoking device used for the purpose of circumventing the prohibition of smoking in public spaces.
